RIGHT TO INFORMATION ACT, 2019, ACT 989

Article 21 (1) (f) of the Constitution of Ghana Provides as follows:

“All persons shall have the right to information, subject to such qualifications and laws as are necessary in a democratic society.”

The Right to Information Act, 2019 (Act 989) was enacted by the Parliament of Ghana and approved by the President in the same year, granting a constitutional right to access information held by public institutions in Ghana.

The Ghana Publishing Company Limited recognizes the essential role of the RTI law in fostering transparency and accountability in public affairs, particularly within Ghana’s democratic framework. Our implementation strategies are guided by five core principles: legal assurances for information access, proactive disclosure, efficient execution processes, alignment with international best practices, and respect for individuals’ privacy rights.

Access to information will be subject to exemptions aimed at protecting the public interest, as specified in the Act.

Application

In accordance with Section 18 of the RTI Act, 2019, application to access information within the Ghana Publishing Company Limited shall be made in writing or orally.

Application in writing shall satisfy the following;

1. Direct the application to the Information Officer of the Ghana Publishing Company Limited.
2. Provide enough details or specifics to ensure the information can be easily recognized.
3. Specify the form and method of accessing the requested information.
4. Clearly outline the applicant’s authority or relationship to the individual they represent, ensuring it meets the information officer’s requirements.
5. Provide the applicant’s full name along with a valid address where communications or notices can be sent.
6. Submit valid identification to verify the applicant’s identity.
7. Ensure the application is signed by the applicant as required.

Some exempt information of this public institution in accordance with the RTI Act, 2019 are;

2. Information relating to Cabinet
3. Information relating to law enforcement and public safety
4. Information affecting internal relations
5. Information that affects the security of the State
6. Economic and any other interests
7. Economic information of third parties
8. Information relating to tax
9. Internal working information of public institutions
10. Parliamentary privilege, fair trial, contempt of court
11. Privilege information
12. Disclosure of personal matters
